Personal Injury

Independent Evaluation (IE) was originally established specifically for personal injury claims. By putting parties at the heart of the process and bringing our extensive legal expertise to bear, our process enables the optimal resolution of all types of personal injury claims, such as:

  • Brain and spinal injury claims
  • Road traffic accidents
  • Workplace accidents and stress in the workplace claims
  • Major incidents such as aircraft and helicopter crashes
  • Chronic Pain and Fibromylagia claims
  • Claims involving injured children and protected parties

The value of the claims we have evaluated ranges from tens of thousands of pounds to multi-millions.

Evaluation has successfully resolved many personal injury claims, including very serious and high profile events such as the M5 fireworks tragedy and near drowning in a local authority swimming pool of a young child who suffered severe brain damage. For details of these and other personal injury cases we have evaluated, please see recent cases.

Personal injury disputes often require IE to evaluate primary liability, contributory negligence, causation, quantum and / or fraud or fundamental dishonesty. All these issues, including the often thorny issue of costs, are resolved by the conclusion of the Evaluation day.

IE is of particular assistance with claims involving injured children and protected parties, where court approval of a compromise is required.
