Resolution of Costs

The Evaluation day has three stages: Guided Analysis, Evaluation and Facilitation, and Resolution of Costs. Here we deal with the third and final stage, the Resolution of Costs.

Stage 3: Resolution of Costs

In response to requests from disputing parties and their legal advisers, IE has evolved processes to ensure that costs and all ancillary issues are dealt with on the same day as the Evaluation. All costs and damages are invariably paid by BACS within a matter of days. This means there are no outstanding issues left unresolved, so the parties have a real sense of closure and can begin to move on.

In contrast, when a case proceeds through the court system, once it finally comes to trial and the judgment is delivered, the parties usually have to wait many more weeks or months before the court reconvenes to announce its decision relating to costs. In the meantime, the parties have to undergo a detailed costs assessment, which can be both lengthy and notoriously uncertain.

One of the many advantages of IE is that it avoids all this by dealing with costs on the day of the Evaluation. Evaluators are very familiar with the costs process, having conducted cost budgeting as judges or as barristers, so this is very much part of their expertise.

Parties leave IE knowing that all aspects of their dispute have been resolved completely; they can begin to put the dispute behind them and get on with their lives, and solicitors and insurers can direct their attention to resolving their next dispute.
