What are Bespoke Evaluations?

Independent Evaluation has established a reputation for being able to resolve even the most difficult or complex disputes. Some conflicts, however, such as Best Interest cases and Intensive Care (ICU) disputes, are particularly difficult and require special treatment in order to maximise the chances of a successful outcome. In response to situations like these, we adapt our process of Independent Evaluation as necessary to create a Bespoke Evaluation.

Advantages of Bespoke Evaluations

Although the process of Independent Evaluation must be conducted correctly in order to succeed, it is also agile. This means we are able to create Bespoke Evaluations to meet the specific challenges associated with certain types of dispute.

An excellent example of this is the bespoke form of evaluation we have developed for hospital disputes relating to critically ill and terminally ill patients. For Best Interests and ICU disputes, we have adapted our process to bring in a second Evaluator with specialist ICU Consultant experience. This means that these particularly difficult cases are evaluated by a unique combination of top, independent legal AND medical experts, rather than relying purely on legal expertise. Both the legal and medical Evaluators are genuinely independent of the NHS/NHSR. This provides disputing parties with the best possible chance of resolving the conflict and restoring the patient – relative – clinician relationship.

Another example is the bespoke model we have developed for the evaluation of disputes relating to the mis-selling of solar panels.

Our Bespoke Evaluations deliver the best possible outcomes for people involved in the most difficult and complex legal disputes, and they do so far more quickly than the courts, which continue to experience long delays. Unlike the adversarial court process, our focus is on the resolution rather than the dispute, forging collaboration between parties even when their legal positions are entrenched, and facilitating parties towards the best possible settlement for all sides.
As a result of the Covid-19 pandemic, the court backlog is worse than ever, so IE in all its forms has become an even more attractive alternative.
