Travel, Personal Injury, Clinical Negligence

James was called to the Bar in 1991 and has specialised in personal injury work for 25 years. He has extensive experience representing both claimants and defendants in catastrophic injury, brain injury and high value chronic pain cases as well as a wide array of manifestations of clinical negligence and occupational illness. He has an interest in product liability and cases raising scientific aspects of defect or causation.

Expertise

James’ involvement with travel and the law may be traced back to 1994 to 1998, when he was called to the Bar of Bermuda in order to contest cases there. Since then, James has had a travel, overseas injury and jurisdictional issues practice complementing regular appearances for clients in related leisure sectors including vicarious liability arguments relating to assault and misconduct by doormen, guides and entertainers and several sexual assault claims in recent years. His scientific degree and experience lends helpful analysis and specialisation to diverse matters such as engineering failures, foreign safety practices, swimming pool technology, HACCP systems, causation in food poisoning, post-infective IBS, rheumatoid, haemolytic uraemic kidney injury complications and Legionnaires cases. James has also conducted numerous actions arising from clinical/care home and motor racing cases.

James is a specialist personal injury practitioner, acting for claimants and defendants. His experience is broad, and includes: fatal accidents including complex demonstrations of financial consequences, head injury including gross and subtle brain injuries, traumatic amputation with sophisticated prosthetics requirements, chronic pain conditions, occupational disease, and fatal and catastrophic head and bodily injury often in consequence of cycling, motorcycling and motor racing accidents.

James has acted for Claimants and defendants in Clinical Negligence cases. His work has included advising in cerebral palsy and birth injury cases.

James also specialises in health & safety, and is regularly instructed to act in relation to prosecution arising from serious accidents and near misses in industry, freight transport, medical and care institutions.

James has been an enthusiast for ADR who, soon after mediations and joint settlement meetings began, noted the significance of well-judged comment or analysis of case merits from judges as an important aid to parties attempting to reach a resolution, rather than prolong the dispute which might otherwise run on to trial. Of all the forms of ADR, James favours the early neutral evaluation approach and specifically the bespoke service of IE.
